Illegal Seizure

        In July 1997, I had 4 animals stolen from me, [we are living in a rural area outside of city limits].  Two were very high content wolfdogs (96% and 98+%), one was a low content, and one was a mutt. A person, or persons, came onto my property (past several no trespassing signs), removed a [locked] gate and chain from the animals enclosure, and took all four [dogs]. (The gate was completely removed from the fence to gain access.) They later dropped off the low content female and the mutt at the local Humane Society, from which we were able to trace them and find out their identity.

        The female high content reportedly died during transit, and the male is now at a facility in Houston.  These animals were reported stolen immediately, the two at the animal shelter were recovered within a couple of days, and I managed to get a name and address of the person responsible for the removal of the animals.  All of this information was turned over to the investigator on the case.

        It turns out that the gentleman that was involved in all of this was a member of the local humane society (where the two animals were recovered from) and a very large contributor to the foundation. Anyway...  the investigator on the case originally told us that he could not do anything, as the fellow was claiming the animals were neglected and he was acting under the Humane Society in removing them.

        This did not sound right to me, so I contacted several other Humane society's and asked them what their rights would be in such a case. Of course, all of them told me they would have to be working in conjunction with the local law enforcement to remove these animals, if indeed there was a problem.  That was not the case here.  The animals were being cared for, were under the care of a vet, and were in very good condition.  I had asked that the body of the female be returned to me for autopsy, to prove that she did not die as a result of abuse on my part, and to show that they were in fact in good physical condition.  This has not been done.

        It was not until I contacted the Attorney General's office that i could even get the investigator to pursue this case.  By that time, the individual involved had admitted to taking the animals, but would not make a written statement.  The investigator finally took a statement from us in October to give to the District Attorney, but since then nothing has been done... they have not served any warrants, attempted to get back the animal that is being held in houston, arrested the gentleman involved... nothing.

        **The owner is currently pursuing other legal avenues.
